These Terms of Service ("Terms") govern your access to and use of the SAVisa platform operated by matata.software (Pty) Ltd ("we", "us", or "our"). By using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SAVisa, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services. We may update these Terms from time to time, and continued use after changes constitutes acceptance.

2. Description of Service

SAVisa is an AI-powered guidance platform that helps users navigate the South African visa application process. Our services include:

  • Visa type identification and recommendation tools.
  • Document checklist generation and validation.
  • AI-powered application review and readiness scoring.
  • Processing time estimates and fee calculations.
  • Immigration glossary, directive tracking, and educational resources.

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials confidential and secure.
  • Notify us immediately of any unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or to facilitate immigration fraud.
  • Upload false, misleading, or fraudulent documents or information.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Scrape, crawl, or use automated tools to extract data from the platform without our written consent.
  • Resell or redistribute our services without an API or Enterprise agreement.
  • Interfere with the proper functioning of the platform.

5. Intellectual Property

All content, software, designs, and trademarks on the platform are owned by or licensed to matata.software. You may not copy, modify, distribute, or create derivative works from our content without written permission.

You retain ownership of any documents and data you upload. By uploading content, you grant us a limited licence to process and analyse it for the purpose of providing our services.

6. Limitation of Liability

To the maximum extent permitted by South African law:

  • Our platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee that our AI-generated guidance will result in a successful visa application.
  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform.
  • Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Disclaimer - We Are Not a Law Firm

SAVisa is NOT a law firm, immigration attorney, or registered immigration practitioner.

The information and tools we provide are for guidance and educational purposes only and do not constitute legal advice. Visa applications involve complex legal matters, and outcomes depend on the Department of Home Affairs and other authorities.

We strongly recommend consulting a registered immigration practitioner (as defined in the Immigration Act 13 of 2002) for complex cases, appeals, or if you are unsure about your situation.

8. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

9. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes via email or a notice on the platform. Your continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
