ZEP Holders - Policy Clarification (No PR Pathway)

Department of Home AffairsIssued: 15 April 2026Effective: 15 April 2026

Summary

Clarifies that ZEP holders do NOT qualify for permanent residence. Issued after Deputy Minister Nzuza's comments on Newzroom Afrika created confusion.

Full Detail

Following Deputy Minister Njabulo Nzuza's television interview on Newzroom Afrika (14 April 2026) discussing the Revised White Paper on Citizenship, Immigration and Refugee Protection, which led to widespread media misinterpretation that ZEP holders had been granted a pathway to permanent residence, the Department categorically stated: 1. There has been NO change in policy regarding ZEP holders. 2. Current ZEP permits remain valid until 29 May 2027 (per Directive 21 of 2025). 3. ZEP holders do NOT qualify for permanent residence permits under conditions of their permits. 4. Public consultations on the future of ZEP and LEP are ongoing. 5. A comprehensive policy report with recommendations will go to Cabinet by end of 2026/27 financial year. Context: Helen Suzman Foundation court challenge mandated PAJA-compliant decision-making on exemption permits.

Impact on Applications

Prevents misinformation. ZEP holders must not assume they can apply for PR. Must explore other legal pathways (e.g., work visa → PR route) if seeking permanent status.
